网络音乐作品著作权保护中的问题及对策 摘 要 全球经济一体化是一把双刃剑，既给我们带来了巨大的便利和经济利益也对我们新时代的生活带来了巨大的挑战。网络音乐作品就是诞生于这样的环境，它与传统的音乐著作品有着天壤之别，它摆脱了传统音乐作品即时性、固定性的特征，将音乐著作品用数字符号进行替代，形成了制作成本低、复制方便、便于携带等优势。正是由于网络音乐作品这些新型的特征，给著作权人合法权利的维护带来了新的挑战。层出不穷的侵权案件值得我们反思，怎样才能更好的维护著作权人的合法权益呢？ 我国还没有系统的网络著作品保护体系，现存的法律保护制度还存在诸多问题，本文从网络服务提供商以及个人著作者、个人网络用户的角度对著作权可能发生的侵害进行分析，旨在通过司法保护手段、网络服务提供商、个人用户以及补偿金制度四个方面建立起维权的保护体系，主要针对所产生的问题，提供相关的建议。 关键字：网络音乐作品；网络服务提供商；著作权； I ON THE PROTECTION OF COPYRIGHT MUSICAL WORKS NETWORKS ABSTRACT The global economic integration is a double-edged sword, which not only brings us great convenience and economic benefits, but also brings a great challenge to the life of our new era. Network music is born in such an environment, there is a big difference between the traditional music works and the network music . It gets rid of the immediacy and fixed feature of traditional music. It’s replaced by the digit symbols, and formed a production cost low, easy to copy, easy to carry, and other advantages. It brings new challenges to safeguard the the copyright owner’s legitimate rights because of the new features of the network music. We should ponder over the infringement cases emerge in an endless stream, how to better safeguard the legitimate interests of copyright holders? China has no network system with content protection system, the existing system of legal protection are still exist many problems. From the perspective of network service providers, individual authors, and individual network user, the article has analyzed the copyright infringement, aimed to establish protection system through the four aspects of the justice means of protection, network service providers, individual users and compensation system.
