项目编号:SY-09516-GG 信函Letter 项目名称Project:合肥京东方B3项BOEHF 编号Ref No: PM-L-1005-1960 致To: （见所附“收件人”清单） 抄送Cc: 标题Subject: 关于项目移交证书(完工证明)及相关事宜 Taking-Over Certificate(TOC) and Relevant Issues Required Reply: □Yes ■No 承包商针对原合同金额（或被认可的变更合同金额）在申请有关包含开办费的所有工程量的工程款时，必须附上项目移交证书(完工证明)。 The contractor must submit the Taking-Over Certificate (or Acceptance Certificate, hereinafter collectively referred to as the “Taking-Over Certificate”) in case that he applies for the full payment of the contract amount (or revised contract amount approved by the Employer) together with such payment application. 与上述事项相关联，指定分包商在申请相关分包工程的有关包含开办费的所有工程量的工程款时，须提交以下必须完成项已完成的相关证明资料（在以下1至10项中只限于与自身工作内容相关的部分）。 In case of nominated subcontractor, he shall submit the written confirmation and supporting document as specified, if applicable among items 1 to 10 below, which prove the completion of his works when he applies for full payment of the contract amount (or revised contract amount approved by the Employer). 项目移交证书(完工证明)中所明示的完成日期与合同工期(或Key Date, 或安装就位的期限)相比有延迟时，必须对工期延迟的合理性提出证明并得到认可。对于未经认可的工期延迟，业主可以从工程款中扣除合同上明示的延迟补偿金（或罚款）。 If the completion date specified in the Taking-Over Certificate is behind the completion date (or Key Date, or Date of Set-up on Position) of the contract the Employer may deduct corresponding amount for delayed time as Liquidated Damages (or Penalty) stated in the contract unless otherwise the contractor obtains the approval for the extension of time. 以缺失整改记录（NCR）或其他文件形式指明的施工质量未满足要求或承包商不执行指示等缺陷，承包商须书面证明其改善结果。对于未能证明的部分，业主可以从工程款中扣除相应的金额。 Unless otherwise the contractor shall prove by written the improvement against issues raised by NCR or any other document in relation to the deficiency of quality or incompliance with instruction, the Employer may deduct the corresponding amount to such issues as is not proved by written in their improvement. 合同包号CP： 日期Date: 2010-05-26 自From: 世源科技工程/ 现代综合设计（韩国） 1/9 GF-001-01 (Rev.01) 项目编号:SY-09516-GG 承包商应根据合同条款及时申请并获得项目移交证书(完工证明)，并对疏于此项工作而导致的工程款支付延迟等将自负全责。 The contractor shall apply for the Taking-Over Certificate in due course and receive the Taking-Over Certificate on time. Any consequences including delay of payment caused by negligence of applying and receiving the Taking-Over Certificate shall be fully under the contractor’s responsibilities. 请各包商在申请移交证书时提交以下必须完成项已完成的相关证明资料（只限于与自身工作内容相关的部分）： The contractor shall submit the written confirmation and supporting document proving the completion, if applicable, together with application of the Taking-Over Certificate as follows: 1、 剩余工作完成确认函（Punch List上得到监理、管理公司及业主的有关确认完成的签字认可后提交）； Confirmation of outstanding works completion (submit Punch List of outstanding works inspected and signed by Jianli, Engineer, and Employer upon completion thereof); 2、 项目法定竣工（与政府认证相关）所要求的所有资料提交确认函 （使用附件中的标准格式“Form TOC-a”）； Confirmation of document submission required for project statutory completion (use attached “Form TOC-a”); 3、 各类报验、检测资料（含监理、政府监管部门涉及内容）提交确认函（使用附件中的标准格式“Form TOC-b”）； Confirmation of inspection and test report submission statutorily required including document required by Jianli (use attached “Form TOC-b”); 4、 设备、材料批准及进场报验资料（提交现况表）； Material and equipment approval document including inspection record of their delivery to project site (submit status); 5、 各类书面文件内容的处理结果资料（提交现况表）； Document proving settlement of issues raised by various correspondence exchanged in relation to the contract works (submit status); 6、 竣工图纸提交确认函（使用附件中的标准格式“Form TOC-c”）； Confirmation of As-built Drawing submission (use attached “Form TOC-c”); 7、 工程培训完结确认函（使用附件中的标准格式“Form TOC-d”）； Confirmation of Training completion (use attached “Form TOC-d”);
