RFQ Terms & Conditions商务标条款条件 1. There will be no confidentiality obligation on the Company and that the bidder agrees to hold all information as provided in the RFQ confidential except as necessary to meet its requirements投标商对本公司没有保密义务，而必须对外保密本公司所提供的所有商务标机密，但为满足本公司需求的行为除外。 2. Company, reserve the right to negotiate on all or any part of the quotation, and any award will be contingent upon the bidder being fully qualified.本公司有权对报价的全部或任意部分进行谈判协商，中标者必须是具备相应资质的投标商。 3. Company, at its sole discretion, reserves the right to accept or reject any or all of the bids received and shall not be bound to give reasons for any decision.本公司有权全权决定接受或拒绝任何接收到的投标，有权不公布本公司做出的任何决定的原因。 4. Any subsequent award of a contract is conditional upon the contractor being meet qualification standard by Company.其后，任何合同的签署必须以承包商满足公司制定的资质标准为基础。 5. The Company reserves the right to reject any or all bid proposals, to award to any Bidder, to award to more than one Bidder or choose not to make any award at all as a result of this bid invitation. Labor Practices Compliance劳动守则 The Supplier understands that it shall comply with all applicable law prohibiting the utilization of forced or compulsory labor.承包商应遵守所有适用的法律，禁止强迫或强制劳动等。 The Supplier understands that it shall provide its employees with working conditions, including payment of wages and benefits, which comply with all applicable laws.承包商应为其员工提供合法工作条件，包括工资和福利。 The Supplier understands that it shall ensure that its employee meet the legal employment age requirements in the country of employment.承包商应确保其雇员达到法定就业年龄。 Adherence to these stated requirement is a condition of this RFQ该商务标中标的条件之一就是遵守以上所有规定。 7. Bidder shall aware that all services provide must be complied with Company's Contractor Safety Manual, and all incur cost to this requirement must be inclusive in the bidder's proposal.投标商应注意，所有提供的业务必须遵守本公司针对承包商的安全守则，建设过程中所需全部成本必须包含在投标商的商务标中。 8. Illegal Information Brokering (required for value > 10M$)违法信息中间商交易（金额>1千万美元） Company and Bidder are aware of a practice where consultants (term” Illegal Information Brokers”) approach bidders and offer them confidential information or illicit influence to obtain business through corruption of the tendering process.本公司与投标商都知道一种做法，即中间商（“违法信息中间商交易”）联系投标商，为其提供机密信息或非法影响，通过招标过程中的腐败获得业务。 Bidder recognizes that the practice of “Illegal Information Brokering” or any other corruption of the contract award process is not permitted by Company and Bidder warrants and represents that he has not and will not utilize “Illegal Information Brokering” in connection with this contract.投标商应该承认“违法信息中间商交易”或其他合同授权过程中的任何腐败行为是本公司和授权投标商所禁止的，投标商在履行本合同过程中必须一概不利用“违法信息中间商交易”。 Bidder agrees that if an “Illegal Information Brokering” approaches Bidder concerning this Tender, Bidder will contact Company Procurement Services Manager or Finance Director.
